In business, there’s always the possibility of being involved in litigation. Your lawyer will no doubt offer timely advice, but here’s a tip that can save you a lot of dollars and possibly save your business, too.
Make the effort to sit around the table before you get to court, and try to resolve matters on a common sense basis. Do some horse trading. The last thing you want or need is to be spending an enormous amount of money on court costs – this may sound the death knell for your business. Think constantly how you can resolve the matter, not only before you get to court but while you’re there.

Well said Winno. I have been preaching that gospel for years but so many business owners till don’t get the message!!! I have entirely changed my legal practice emphasis in recent years so that I now strive to keep people out of Court and to explore mediated solutions (admittedly with varying degrees of success…..). Keep up the good work.
There are three major problems involved here.
BIG EGO is the first.
The inability to back down, take a small hit, and keep going forward. Usually a bloke problem.
Second is testosterone. Closely related to #1. As in “I can’t let heer get away with that!”
Third is the need to see justice done. That can set you back many thousands of dollars, just so you can then say “See, I was right!”
But after months of sleepless nights and reduced work output, ask yourself “Was it worth it?”
Well said Brian and points to remember, thanks!
That’s great Paul and I hope that it brings both you and your clients fantastic success. It wonderful that you seek to take the mediation route… I’ve been a supporter of that approach for ages.
